General

Automated messages may be sent using an automatic telephone dialing system to the mobile telephone number you provided when signing up or any other number that you designate.

Message frequency varies, and additional mobile messages may be sent periodically based on your interaction with Club Allenby. Club Allenby reserves the right to alter the frequency of messages sent at any time to increase or decrease the total number of sent messages. Club Allenby also reserves the right to change the short code or phone number or alphanumeric sender where messages are sent.

Your usual message and data rates may apply. If you have any questions about your text plan or data plan, it is best to contact your mobile provider. Your mobile provider is not liable for delayed or undelivered messages.

Your consent to receive marketing messages is not a condition of purchase.

Carriers are not liable for delayed or undelivered messages.

Cancellation

Messages will provide instructions to unsubscribe either by texting STOP or through an included link. After you unsubscribe, we will send you a message to confirm that you have been unsubscribed and no more messages will be sent. If you would like to receive messages from Club Allenby again, just sign up as you did the first time and Club Allenby will start sending messages to you again.

The duty to inform us based on the above events is a condition of using this service to receive messages.

Messaging Terms Changes

We reserve the right to change or terminate our messaging program at any time. We also reserve the right to update these Messaging Terms at any time. Your continued enrollment following such changes shall constitute your acceptance of such changes.


4. Terms & Conditions

Membership Terms

  • Membership Duration: Your Membership with the Club shall last indefinitely from the day you join the Club (the "Membership Term").

  • Auto-Renewal: Your Membership shall auto-renew on a quarterly or annual basis (each such term a "Renewal Term"), unless you provide notice to the Company at least 14 days prior to the expiration of your then-current Membership Term that you wish to opt out of such Renewal Term.

  • Cancellation: You may cancel your Membership at any time with at least 14 days’ notice to the Company. If you decide to cancel mid-term (for example, before your quarter ends), you will not receive a refund for the term you paid for.

  • Termination by Company: The Company may terminate your Membership at any time, in its sole discretion, with or without cause. This includes, but is not limited to, termination for violation of the Club Rules, Code of Conduct, or these Terms and Conditions.

  • Membership Changes: Company reserves the right to change or modify the terms of membership, including pricing, benefits, and policies, at any time. Such changes will be communicated to members through email and website updates. Continued use of membership privileges after such notification constitutes acceptance of the revised terms.

Event Participation

  • Access: Club events ("Events") are by invitation only. Events are on Club property and off-site. Members may apply for invitations but are not guaranteed access. The Company reserves the right to revoke any invitation.

  • Event Fees: Each Event will require a ticket purchase ("Event Fee"), which must be paid prior to attendance. Event Fees are non-refundable unless expressly provided otherwise.

  • Other Expenses: Purchases of food, drinks, or participation in activities at Events are separate from the Event Fee.

  • Cancellation or Alteration: If an Event is canceled or altered, Members will be notified as soon as practicable.

  • Guest Policy: Guests are permitted at Events on an Event-by-Event basis and are also subject to the Code of Conduct.

Code of Conduct & Behavior Expectations

  • Respectful Conduct: Members are expected to act respectfully and responsibly in accordance with the Club’s Code of Conduct.

  • Misconduct: Harassment, discrimination, or violation of rules may result in immediate termination of Membership without refund.

  • Confidentiality: Members must maintain the confidentiality of private information shared within the Club.

Photography & Videography

By attending events, you consent to being photographed or recorded for promotional use.

Liability & Indemnification

  • Personal Property: The Company shall not be liable for the loss, theft, or damage of personal property at any Events or on Club property.

  • Indemnification: Members agree to indemnify and hold the Company harmless from any claims, damages, or losses arising from their participation in the Club, Events, or use of Club property.

  • Liability Cap: Maximum liability shall not exceed $500.

Social Media & Publicity

  • Restrictions: Members cannot use Club branding for commercial purposes without consent.

  • Defamation & Harmful Content: Any inappropriate social media activity related to Club Allenby LLC may lead to termination or legal action.

Dispute Resolution & Governing Law

  • Arbitration: Disputes will be resolved through binding arbitration under the American Arbitration Association in Florida.

  • Governing Law: This Agreement is governed by the laws of Florida.
